Welcome to Jamaya Marketing, Ltd., which provides Programs and delivery services to you subject to the following terms and conditions. You must accept these terms and conditions of use. Please read them carefully.
- The Consumer Saving Program allows consumers to receive 2% to 20% rebate at participating businesses by presenting the Cashbay Loyalty Card at time of payment.
- The Loyalty Card Program allows companies to attract and retain customers while saving money in marketing costs.
- The Entrepreneurship Program is a system that helps you become a successful entrepreneur.
- The Fundraising Program supports your efforts to raise money for your favorite organization.
- Media Partners. they can use the cards to pull in advertising dollars from unsold space
This document constitutes the agreement ("Agreement") between you and Jamaya Marketing Ltd. the owner and operator of the Cashbay Social Network. In this Agreement, "Customer", "you" and "your" mean the person or persons, companies or organizations who utilize this site to purchase or join in any program. "We", "us" and "our" mean Jamaya Marketing, Ltd., the Programs and our successors, affiliates and assignees.
When you visit the Website or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically, including via text message. We will communicate with you by e-mail or text. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Password Procedures
To improve the security of your personal details and Account information, it is highly recommended that you:
- Choose a strong password with more than 8 characters with a combination of alphanumeric characters.
- Change your password every 2 months.
- Never reuse the same password.
- Never share your password with others.
You are responsible for maintaining the confidentiality of any password(s) you are given to access the Cashbay Social application. Keep your password confidential and do not let others use your account.
1. You understand that by joining you are purchasing one or more programs included on this site. You will also have the right to sell one or all the programs that you are part of, and will be compensated for your sales as shown on our site program page.
2. Proof of purchase is required for membership. Any unauthorized accounts will be terminated.
3. You agree not to make any claims regarding sales, unless you have proof of such claims.
4. You must have a valid email address, and you agree to notify us if your email changes.
5. This service is provided on an as is, as available service. We make no warranties of any kind, either expressed or implied.
6. Under no circumstances, including negligence, shall we, or anyone else involved in creating, producing or distributing this service, be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or inability to use this service, and all the files and software contained within it, including, but not limited to, reliance on any information obtained through this service; or that result from mistakes, omissions, interruptions, deletion of files or errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to our records, programs or services.
7. USE OF YOUR SERVICE.
The following actions may result in the immediate termination of your membership without recourse and should NOT be done:
- Sending unsolicited email messages (spam). If you participate in spam on behalf of ANY product or service, you are not eligible!
- Posting messages that contain your affiliate link in Newsgroups that are unrelated to that product or service. (sig file notwithstanding)
- Forging your "From" Address in an email message, or newsgroup posting.
8. If you are under the age of 18, you may use the Cashbay Social Site only with involvement of a parent or guardian. We reserve the right to add or delete material within this site, and otherwise make changes to the service and this agreement without notice.
9. We may terminate without notice, at our sole discretion, any membership deemed to be in breach of this agreement or otherwise found to be abusing or misusing the service, or harassing the other members or administrator in any way.
10. In the unlikely event that this program or site should ever terminate its operations, it's creator, operators, employees, assigns and successors shall not be held liable for any loss whatsoever to our members or affiliates. The material contained within our member’s area, and made available to you upon joining, shall be deemed full and just consideration for payment.
11. Companies and individuals involved with the following activities are NOT ELIGIBLE: selling, providing or linking to unlicensed content, pornography, warez, pirated software, hacking or spamming software, email address lists or harvesting software, or any materials endorsing violence, hatred, revenge, racism, victimization, or criminal activity.
12. We make no claims on how much money you can make with our programs. Your ability to earn depends on a number of factors, including where and how (and how often) you promote the program, and the motivation and ability of those in your downlines, to make sales. Individual results will vary.
13. Members caught spamming or otherwise causing harm to our program will have their accounts terminated, and may be prosecuted for their actions. We will investigate all allegations before taking action.
14. Cancellation and Refund Policy
We do not offer refunds on the Entrepreneurship program fees. “All cancellations for Cashbay Loyalty Card Orders must be received at least 48 business hours before we setup your account and deliver program materials or place branded card order to our card manufacturer. Cancellations must be received in writing by e-mail (sales@thecashbay.com), fax (800-288-3184, ATTN: Cancellation dept), or by US mail (91 North Franklin St. Suite 317, Hempstead, NY 11550, ATTN: Cancellation dept) No refunds will be made for requests received after that time. Refunds will be issued in the same form payment was made. Please allow two weeks for processing.
15. Shipping Policy
100% of the program material is delivered for free every day within continental USA. We will deliver program material to the members via our Entrepreneurs; in some cases we will ship such material via standard mail, Ups or FedEx. All are "ground" services that take 5-7 business days from coast-to-coast (most program material ship from our HQ in Hempstead NY) within three business days following the date of registration in the program.

16. You understand your role as a program member does not constitute a partnership, or employer / employee relationship, and affiliates are considered independent contractors, and as such, you are responsible for your own bookkeeping, taxes, and reporting, where applicable.
17. You agree to accept email updates regarding our program. We will never inundate you with emails or spam. We try to limit mailings to 1 a month per merchant you bought from.
EVERY EFFORT HAS BEEN MADE TO ACCURATELY REPRESENT THIS PRODUCT AND IT'S POTENTIAL. EVEN THOUGH THIS INDUSTRY IS ONE OF THE FEW WHERE ONE CAN WRITE THEIR OWN CHECK IN TERMS OF EARNINGS, THERE IS NO GUARANTEE THAT YOU WILL EARN ANY MONEY USING THE TECHNIQUES AND IDEAS IN THESE MATERIALS.

Governing law
